The rules for using this website, the Digital Growth Audit, quotes and memberships, and the conditions under which we provide our services.

About these terms

These terms apply to the use of this website of JX Systems, a MAGNA GLOBAL LLC company ("we"), including the Digital Growth Audit, the contact and quote forms, and the free tools. By using the site, you accept them. If you do not agree, do not use the site.

The projects and memberships you hire are governed by your written proposal and by these terms. If your proposal contradicts these terms, the proposal prevails.

Who our services are for

Our services are aimed at entrepreneurs, professionals and companies that hire them for their business or professional activity. It is a business-to-business relationship: we do not sell to consumers. When you request a quote or accept a proposal, you confirm that you do so for your business or your professional activity.

If you were nevertheless to hire us as a consumer, you keep the rights that the consumer protection laws of your country grant you and that cannot be excluded (for example, in the European Union, the 14-day right of withdrawal), and those rights prevail over these conditions.

Use of the site

The content of this site is general information about our services and how we work. We may update, change, suspend or withdraw any part of the site without prior notice.

When you submit a form, provide accurate information and share only information you have the right to share, including when you do so on behalf of your business. We explain how we handle that information in our privacy policy.

Memberships and quotes

The memberships (Start, Essential, Boost, Growth, Scale, and Custom) and the systems we describe on this site are a general reference. The specific scope of each project (what it includes, what it does not include, the timelines and the price) is defined in a written quote.

  • Published prices: the prices for Start, Essential, Boost, Growth and Scale are one-time payments for building the system, in US dollars (USD), and do not include any applicable taxes. Custom has a personalized quote based on the project.
  • Monthly maintenance plan: The monthly maintenance plan covers hosting, SSL certificate, updates, security, backups and the adjustment hours for your tier. It starts when we publish your system and covers what we build and host for you. The monthly maintenance plan is paid month to month, with a 12-month commitment from launch; at the end of each 12-month term, it renews for another 12 months unless you give us 30 days' notice. You can cancel a plan or the monthly maintenance plan by giving us 30 days' notice; if you cancel the maintenance plan before the current 12-month term ends, you pay the remaining monthly fees to complete it. Adjustment hours do not carry over from one month to the next. It does not include redesigns, new sections or features, changes to third-party systems or licenses: those are quoted separately. For Scale and Custom, the maintenance plan is set when we evaluate the project, based on its size and its integrations. Anything that exceeds the allowances of each tier (for example, WhatsApp messages or third-party licenses) is charged at cost and with advance notice.
  • Launch guarantee: the publication date of the first version is agreed in writing. If we do not meet it for reasons attributable to us, your first month of the maintenance plan is free. It does not apply to delays due to missing content, access, approvals or payments on your part.
  • No commitment when you request a quote: requesting a quote, by form or by WhatsApp, does not oblige you to hire anything. A quote only commits you when you accept it in writing.
  • Scope of Scale: Scale has no fixed cap. Its scope is defined in your proposal according to the infrastructure of your project. For projects of larger companies, we may bring in partner companies: we tell you in your proposal, and they are bound by the same confidentiality (see Confidentiality and your customers' data).
  • No guaranteed results: neither the memberships nor the systems guarantee specific results. See No guarantee of results.

Payments

  • Who collects payment: payments are received by MAGNA GLOBAL LLC, the company that owns JX Systems, and proposals and invoices are issued in its name.
  • Payment methods: bank transfer in the United States (Mercury) or international transfer (Wise). Each financial institution handles the transfer data under its own terms.
  • Bank details: we only send them in your proposal or invoice; we never publish them on this site. If someone asks you to pay into another account or under another name, confirm it with us first.
  • When you pay: in full, when you accept your written proposal. From Boost, you can also pay the one-time payment in two parts: 50% when you accept the proposal and 50% when you approve the final version, before publishing. Start and Essential are paid in full. For Custom, the payment terms are defined in your proposal. The monthly maintenance plan is paid every month from launch, as agreed in your proposal.
  • Currency and taxes: prices are in US dollars (USD). If your business is in the European Union (including Spain), your proposal and your invoice are issued in euros (EUR), for the amount stated in your proposal. They do not include any applicable taxes or any fees your bank charges for currency conversion or international transfers.
  • Refund and withdrawal: you have 15 days from your first payment to withdraw and request a refund, in writing. We prorate: we charge only for the work done up to the date of your request, according to the stage-by-stage breakdown in your proposal, and return the rest. If we have not started the work yet, we return everything you paid. In both cases, any taxes already paid on the transaction that cannot be recovered and the administrative costs, whose amount is stated in your proposal, are deducted.
  • Maintenance plan and cancellation: the monthly maintenance plan is paid month to month, with a 12-month commitment from launch; at the end of each 12-month term, it renews for another 12 months unless you give us 30 days' notice. You can cancel a plan or the monthly maintenance plan by giving us 30 days' notice; if you cancel the maintenance plan before the current 12-month term ends, you pay the remaining monthly fees to complete it. Your written proposal confirms these conditions.

Timelines, support and language

  • Delivery timelines: they are counted in business days, Monday through Friday. A system is normally ready in 5 to 15 business days, depending on its size; the exact launch date is agreed in writing in your proposal.
  • Support hours: Monday through Friday, 8:00 a.m. to 6:00 p.m. Chile time (America/Santiago); there is no support on weekends. These are the business hours the memberships refer to. Meetings can be requested on any day and at any time.
  • Language of service: we serve you in Spanish or in English. Our team is Spanish-speaking and not native in English, so after each conversation we send you written minutes of what was agreed.

Confidentiality and your customers' data

We treat the information about your business and the data you entrust to us for your project as confidential, and we use them only to provide the service to you. The confidentiality agreement is signed with your proposal.

When the systems we build or maintain process personal data of your customers or contacts (for example, the leads in your CRM), you are the controller of that data and we act as a processor on your behalf (Article 28 of the General Data Protection Regulation, GDPR, where it applies). Therefore:

  • we process it only on your documented instructions and to provide the service;
  • the people who access it are bound by confidentiality;
  • we apply appropriate security measures and notify you without undue delay if we detect a breach that affects it;
  • we only use other providers (for example, hosting, the CRM or a partner company) with your written authorization and with these same obligations;
  • we help you respond to requests from people who exercise their rights over that data;
  • we give you the information needed to show that we meet these obligations;
  • when the relationship ends, we hand the data over to you and delete our copies, unless the law requires us to keep them.

The data processing agreement, with its details, is signed with your proposal. What informs your customers about their data is your privacy policy, not ours.

Handover of your system when it ends

When the project ends or you cancel, we hand everything over to you: the domain, the code, the content, the data and the access. We keep nothing. The handover takes place once what is due under your proposal and these terms has been paid.

  • You receive the code with the right to use it, modify it and host it wherever you want; open-source components keep their own licenses.
  • Third-party accounts and licenses are transferred to your name when their provider's terms allow it.
  • After the handover we delete our copies, except what the law requires us to keep (for example, invoices and accounting records).

The Digital Growth Audit

The Digital Growth Audit is an automatic, informational report. It is generated by a deterministic rules engine from automatic checks of the website you provide and your answers about your business. It has stated limitations:

  • The checks read the initial HTML of the page at the address you provide (normally the home page), as well as robots.txt and the XML sitemap. JavaScript is not executed, so the checks may not see content or tags that are added later.
  • Each check is a single measurement at a given moment. Results may vary at another time, or from another device or location.
  • Findings marked Inferred are based on your answers and have not been independently verified.
  • Areas marked Not verified were not evaluated, and no conclusion is drawn about them.
  • Performance data comes from our own measurement of the server response time and, only when enabled, from Google PageSpeed Insights; in that case, it reflects the methodology of that service.

The audit does not guarantee results. It is not legal, financial, tax or regulatory advice; for those matters, consult a qualified professional. You may use your report within your business and share it with your advisors.

No guarantee of results

We do not guarantee search engine rankings, traffic, leads, revenue or visibility in search engines or in AI-generated answers: not on this site, nor in the audit, nor in a quote, a membership or any recommendation. Results depend on factors we do not control, such as the market, the competition, third-party platforms and how the recommendations are applied.

The articles and guides on this site are general information. When they describe common practices of professionals or hypotheses, they are presented as such, not as established facts.

Intellectual property

The content of this site (including the text, graphics, images, design, code, and the name and logo of JX Systems) is ours or is used with permission. You may view it, print pages and share links for personal use or for the internal use of your business. You may not copy, republish or redistribute substantial parts without our written permission.

The information you send us remains yours. You allow us to use it to prepare your audit or your quote and to respond to you, as described in the privacy policy.

Acceptable use

By using the site, you agree not to:

  • use it in an unlawful, fraudulent or harmful way, or impersonate another person or business;
  • use the audit tool to scan, probe or test non-public systems (such as internal networks, private addresses, non-standard ports or pages that require signing in), or attempt to bypass the protections that block them;
  • automate submissions, bypass the submission limits or use the audit tool to generate load on any website;
  • submit other people's personal data without a legal basis, or malicious content or content that infringes third-party rights;
  • attempt to gain unauthorized access to the site, its servers or its data, or interfere with its operation.

We may block access or discard submissions that violate these rules.

Third-party links and services

The site links to third-party websites (for example, the sources cited in our articles and our social media profiles) and may use third-party services such as WhatsApp or Google PageSpeed Insights. We do not control them and are not responsible for their content, availability or practices. Their own terms and privacy policies apply.

Limitation of liability

The site and the audit are provided "as is" and "as available." To the extent permitted by law, we do not guarantee that they are accurate, complete, uninterrupted or error-free.

To the extent permitted by law, we are not liable for indirect or consequential losses, or for the loss of profits, revenue, data or business opportunities, arising from your use of the site or from your reliance on the audit or other content.

Nothing in these terms excludes or limits liability that the law does not allow to be excluded or limited, including liability for fraud, or rights that cannot be waived, such as those granted to you by the consumer protection laws of your country.

Changes to these terms

We may update these terms from time to time. The date shown above indicates when they last changed. If you keep using the site after a change, you accept the updated terms.
